HelloFresh and Youfoodz: the ACCC's alleged subscription-trap case
On 16 December 2025 the ACCC started separate Federal Court cases against HelloFresh and Youfoodz, alleging they misled new customers about cancelling subscriptions. These are allegations: as at 26 Oct 2026 we found no court decision.
What the ACCC alleges
Everything in this section is the ACCC's allegation, from its media release of 16 December 2025 (read 26 Oct 2026). No court has found that HelloFresh or Youfoodz broke the law.
- The cases are against Grocery Delivery E-Services Australia Pty Ltd (trading as HelloFresh) and Youfoodz Pty Ltd. The ACCC says both are owned by HelloFresh SE.
- The ACCC alleges both businesses told new customers they could cancel online in their account settings before a cut-off, but that customers who did so before the first delivery's cut-off were still charged for, and sent, the first order. It alleges the first delivery could only be cancelled by speaking to customer service.
- The alleged conduct periods are 1 January 2023 to 14 March 2025 (HelloFresh) and 1 October 2022 to 22 November 2024 (Youfoodz). The ACCC says 62,061 HelloFresh customers and 39,408 Youfoodz customers were charged despite cancelling before the cut-off for the first order.
- The ACCC also alleges HelloFresh required payment details to view the full menu, and entered people into an ongoing subscription when they moved on to meal selection.
- The ACCC is seeking compensation orders, penalties, declarations, publication orders, a compliance program and costs.
Where the case stands
As at 26 Oct 2026 we found no judgment or penalty in either case. Legal news site Lawyerly reported on 10 September 2026 that the case was still before the court. We will add a dated note here if the court decides.
What the brands' own pages say now
HelloFresh's current terms say that to cancel a first order you must contact customer service before the first weekly cut-off, and that cancelling the subscription alone does not cancel it (HelloFresh terms, checked 26 Oct 2026). For each brand's own cancellation steps, see how to cancel each service.
